Introduction

Advanced Utility Systems is committed to protecting the privacy and security of your personal information. We also believe in transparency, and this Policy explains how we collect, use, and disclose your personal information. Please read this Policy carefully to learn more about how we handle personal information and what rights you may have under applicable law.

Accountability. We are accountable for the personal information under our control. We have designated a Privacy Officer who is responsible for our compliance with the Personal Information Protection and Electronic Documents Act (“PIPEDA”) and applicable provincial privacy legislation, and who oversees this Policy and our privacy practices. The Privacy Officer’s contact information appears in the “Contact Us” section at the end of this Policy.

When does this Policy apply?

This Policy describes our practices for the personal information for which we are the organization accountable under applicable Canadian privacy legislation. This includes information collected when you visit our website, https://advancedutility.com/ (the “Site”).

This Policy does not apply when we handle personal information on behalf of a customer. For information about a customer’s data practices, please contact the customer directly. We are not responsible for our customers’ privacy or security practices.

This Policy also does not apply to the privacy practices of our corporate affiliates, unless expressly stated. For information about an affiliate’s data practices, please contact that company directly.

The Site is intended for a general audience and is not directed to children. We collect personal information from individuals who choose to submit it to us, including through forms on the Site, including individuals who apply to us for employment. While the individuals who contact us are generally located in the United States and Canada, we may receive personal information from individuals located in other countries, and we process that information in accordance with this Policy and applicable law.

How Do We Collect and Use Your Personal Information?

We collect the following types of personal information for the purposes listed below. You may choose not to provide us with any personal information, but you may not be able to access portions of the Site that require personal information.

We collect, use, and disclose personal information for the purposes identified below, and we identify those purposes at or before the time of collection. We do so with your knowledge and consent, except where the collection, use, or disclosure without consent is permitted or required by PIPEDA, applicable provincial privacy legislation, or other applicable law. We limit our collection of personal information to what is necessary for the identified purposes, and we do not use or disclose personal information for a new purpose without your consent unless permitted or required by law. Where other privacy laws apply to you, we handle your personal information in accordance with those laws.

We may also process personal information when necessary for the establishment, exercise, or defense of legal claims, whether in court, administrative, or other proceedings; obtaining or maintaining insurance coverage; managing risks; obtaining professional advice; or purposes that are consistent with, related to, or ancillary to the purposes and uses described in this Policy for which your personal information was provided to us.

We collect, use, and disclose your personal information with your consent. Your consent may be express or, where the information is not sensitive and the purpose would be considered obvious to a reasonable person, implied. In addition, applicable law permits us to collect, use, or disclose personal information without consent in certain circumstances, including the following:

• Because it is necessary to perform the tasks you have requested or to comply with your instructions or other contractual obligations between you and us.
• To comply with our legal obligations and keep records of our compliance processes.
• Because our legitimate interests, or those of a third-party recipient of your personal information, make the processing necessary, provided those interests are not overridden by your interests or fundamental rights and freedoms.
• Because you have chosen to publish or display your personal information on a public area of the Site, if such areas are available.
• Because it is necessary to protect the life, health, or security of an individual.
• Because the collection, use, or disclosure is otherwise permitted or required by applicable law, including where it is for statistical or scholarly study or research purposes, relates to an investigation of a breach of an agreement or a contravention of law, or is required in response to a lawful request from a government institution.
• Because you have expressly given us consent to process your personal information in a particular manner.

Location of Processing and International Transfers

Personal information is transferred to, stored, and processed in Canada and the United States. Where we transfer personal information to a service provider for processing, including outside the province or country in which you are located, we use contractual and other means to ensure that the service provider provides a comparable level of protection to the personal information while it is being processed on our behalf, and we remain accountable for that information. By sending us personal information or using the Site, you acknowledge that your personal information may be processed in Canada or the United States, and that while it is in another jurisdiction it may be accessible to the courts, law enforcement, and national security authorities of that jurisdiction, which are locations that may not offer the same levels of protection required in your jurisdiction.

Where required, we rely on recognized legal bases to conduct cross-border or international transfers of personal information, such as express consent, transfer necessary for delivery of services pursuant to an agreement, or transfer subject to safeguards intended to protect the personal information.

Cookies and Similar Technologies

First and Third-Party Cookies

A “cookie” is a small file created by a web server that can be stored on your device, if you allow it, for use either during a particular browsing session or a future browsing session. Session cookies are temporarily stored and remain until they expire at the end of your browsing session. Persistent cookies remain stored until they expire or are deleted by you. Local shared objects, also known as flash cookies, may be used to collect and store information about your preferences and navigation to, from, and on a website. First-party cookies are set by the website you are visiting and can only be read by that site. Third-party cookies are set by a party other than that website.

Other Similar Technologies

In addition to cookies, other data collection technologies may be used, such as Internet tags, web beacons, pixels, clear gifs, pixel tags, single-pixel gifs, and navigational data collection such as log files and server logs. These technologies can collect data as you navigate through and interact with a website. UTM codes are strings that can appear in a URL when you move from one web page or website to another and may represent information about your browsing, such as which advertisement, page, or publisher sent you to the receiving website.

What Cookies and Similar Technologies Are in Use, and Why Do We Use Them?

Google Analytics. We use Google Analytics to collect and process statistical data about the number of people using the Site and to better understand how they find and use the Site. The data collected includes data related to your device or browser, your IP address, and on-site activities to measure and report statistics about user interactions. The information stored is reduced to a random identifier. Any data collected is used in accordance with this Policy and Google’s privacy policy.

Your consent. Other than strictly necessary cookies, which are required for the Site to function, we do not place cookies or similar technologies on your device, and the technologies described below do not load, unless and until you have given your prior consent through our cookie consent banner. You may accept all, reject all, or select which categories you allow, and you may change or withdraw your choices at any time through the cookie preferences link on the Site. Withdrawing consent does not affect the lawfulness of processing carried out before withdrawal.

Microsoft (Bing) Webmaster Tools. We use Microsoft (Bing) Webmaster Tools to understand the performance of our Site and to better understand how users find the Site.

ActiveCampaign. We use ActiveCampaign to automate certain email communications to users of our Site and to provide additional opportunities for engagement with our Site. ActiveCampaign also uses site-tracking cookies to record whether tracking is enabled for your browser, to associate your browsing of the Site with your contact record where you have identified yourself to us, to temporarily store an email address you submit through a form, and to attribute enquiries to marketing campaigns. These cookies are not set unless you have given your prior consent.

Metricool. We use Metricool to measure and report on the performance of our Site and our social media and marketing content, including aggregated statistics about visits to and engagement with the Site. Metricool states that its website visitor tracking tool operates without cookies and does not store identifiers on your device.

Microsoft Clarity. We use Microsoft Clarity to understand how visitors interact with the Site, including through heatmaps and session recordings that capture mouse movements, clicks, scrolling, and page navigation. Clarity sets cookies to distinguish visitors, group activity into sessions, and recognize returning visitors. Clarity is configured to mask text entered into form fields, and we do not use it to record the content you type. Any data collected is used in accordance with this Policy and the Microsoft privacy statement. We do not load Clarity unless you have given your prior consent, and you may withdraw consent at any time through your cookie preferences.

Cookie inventory for legal and technical validation: In addition to the Google Analytics cookies listed below, Microsoft Clarity sets _clck (Clarity user identifier and browser preferences, approximately one year), _clsk (links page views into a single session recording, one day), CLID (identifies when Clarity first saw you, approximately one year), MUID (Microsoft browser identifier used for analytics and service operations, approximately one year), MR (indicates whether MUID should be refreshed, approximately seven days), ANONCHK (indicates whether MUID is transmitted to advertising services, short-lived) and SM (synchronizes MUID across Microsoft domains, session). ActiveCampaign sets ac_enable_tracking (records whether tracking is enabled, approximately one year), an account-specific contact identifier cookie and validation hash (approximately one year), trackcmp_email (temporarily stores an email address submitted through a form, session) and prism_* site-tracking cookies (duration varies by implementation). Cookie names and durations are set by these providers and may change.

Some third parties may use data collection technologies to collect information about you when you browse the Internet. We do not control these third parties’ technologies or how they may be used. If you have questions about targeted content, you should contact the responsible party directly or consult their privacy policies.

Choices About Cookies

You control non-essential cookies through the cookie consent banner presented when you first visit the Site and through the cookie preferences link available on the Site at any time. There you may accept all cookies, reject all non-essential cookies, or choose which categories you allow, and you may change or withdraw your choices at any time. Most web browsers are set by default to accept cookies. If you do not wish to receive cookies, you may also set your browser to refuse all or some types of cookies or to alert you when cookies are being stored. These settings may affect your enjoyment of the Site’s functionality. Adjusting cookie settings may not fully delete cookies that have already been created. Global Privacy Control and other opt-out signals. We recognize the Global Privacy Control (GPC) and other opt-out preference signals transmitted by your browser or device where required by applicable law. Where we detect such a signal, we treat it as a request to opt out of the sale or sharing of personal information and of targeted advertising for that browser or device, and we do not load non-essential cookies or similar technologies for that browser or device. Because a signal is tied to the browser or device you are using, you will need to enable it on each browser and device you use.

How Do We Share Your Personal Information?

When we are the organization accountable for the personal information, and where permitted or required by applicable law, we may share each of the categories of personal information described above in the following contexts.

Legal Obligations and Rights	We disclose personal information in response to subpoenas, warrants, court orders, or other legal process, or to comply with relevant laws. We may also share personal information to establish or exercise legal rights, defend against legal claims, investigate, prevent, or take action regarding possible illegal activities, suspected fraud, safety of person or property, or a violation of contract. We may also disclose personal information as needed to protect vital interests.
Service Providers	We share personal information with agents, contractors, and service providers. Among other things, service providers help administer the Site, support the provision of products and services, send marketing communications, provide technical support, and assist with other legitimate purposes permitted by law.
Professional Advisors	We share personal information with insurers and other professional advisors, including attorneys, accountants, consultants, and auditors, that need access to information to provide operational or other support services on our behalf.
Deidentified or Aggregated Data	We share aggregated information and information that does not identify any specific individual, such as groupings of demographic data and customer preferences, for compliance with reporting obligations, business or marketing purposes, and to assist us and others in understanding users’ interests, habits, and usage patterns for certain programs, content, services, marketing, or functionality.

How Long Do We Process Your Information?

We retain and use personal information for as long as necessary to fulfill the purposes for which it was collected, comply with business requirements and legal obligations, resolve disputes, protect assets, provide services, and enforce agreements. We retain records of the cookie consent choices you make, including the categories accepted or rejected and the date of your choice, in order to demonstrate that consent was obtained and to honor your preferences on future visits.

We take reasonable steps to delete personal information when we have a legal obligation to do so, no longer have a purpose for retaining the information, or you ask us to delete it, unless we determine that deletion would violate existing legal, regulatory, dispute resolution, contractual, or similar obligations. We may also delete personal information if we believe it is incomplete or inaccurate or that continued storage is contrary to legal obligations or business objectives.

We will destroy or de-identify personal information if we no longer need it for any purpose for which it was collected, provided we are not otherwise required to retain it under applicable law. To the extent permitted by law, we may retain and use anonymous, de-identified, and aggregated information for performance reporting, benchmarking, analytics, and product or service improvement. When we delete data, it may be removed from active servers and databases but remain in archives where deletion is not practical or possible. We are required by law to maintain records of consumer requests submitted under the California Consumer Privacy Act and our responses for at least 24 months, and we use this information only for recordkeeping purposes.

How Do We Protect Your Personal Information?

We have put security safeguards in place to protect personal information from being accidentally lost, used, altered, disclosed, or accessed in an unauthorized manner and to detect fraudulent identity-verification activity, including when transmitting personal information in response to requests to exercise privacy rights. The safeguards we apply are appropriate to the sensitivity of the personal information. From time to time, we review security procedures to consider appropriate new technologies and methods.

However, no security system is perfect, and no data transmission is 100% secure. As a result, while we strive to protect personal information, we cannot guarantee or warrant the security of any information transmitted to or from the Site or services. Your use of the Site is at your own risk. If a breach of our security safeguards involving your personal information creates a real risk of significant harm to you, we will notify you and the Office of the Privacy Commissioner of Canada, and any other applicable regulator, as required by applicable law, and we will keep records of breaches of security safeguards as required by law.

Your Rights and Choices

Please use the “Contact Us” details at the end of this Policy to exercise your rights and choices under this Policy.

Email Preferences. We send commercial electronic messages only with your express consent or on the basis of an existing business relationship, as permitted under Canada’s Anti-Spam Legislation, and each message identifies us and includes our contact details and a working unsubscribe link. If you no longer wish to receive communications from us via email, you may opt out by clicking the “unsubscribe” link at the bottom of our emails or by contacting us via the “Contact Us” details at the end of this Policy and providing your name and email address so that we may identify you in the opt-out process. Once we receive your instruction, we will give effect to it within 10 business days. Please note that registered users cannot opt out of receiving transactional emails related to their account.

Accuracy and Updating Your Personal Information. Our goal is to keep your personal information accurate, current, and complete as is necessary for the purposes for which it is to be used. If personal information you have provided to us changes, please let us know via the “Contact Us” details at the end of this Policy, and you may ask us to correct information you believe is inaccurate or incomplete. We are not responsible for losses arising from inaccurate, inauthentic, deficient, or incomplete personal information that you provide to us.

Complaints. If you believe that your rights relating to your personal information have been violated, you may lodge a complaint with us by contacting our Privacy Officer via the “Contact Us” details at the end of this Policy. We will investigate all complaints, respond to you, and take appropriate corrective measures where a complaint is found to be justified. If you are not satisfied with our response, you may contact the Office of the Privacy Commissioner of Canada, or, where applicable, the Office of the Information and Privacy Commissioner of Alberta, the Office of the Information and Privacy Commissioner for British Columbia, or the Commission d’accès à l’information du Québec.

Individual Rights. Under PIPEDA and applicable provincial privacy legislation, you have the right to access the personal information we hold about you, to be informed of how it has been used and to whom it has been disclosed, to request correction of inaccurate or incomplete information, and to withdraw your consent at any time, subject to legal and contractual restrictions and reasonable notice; if you withdraw consent, we may no longer be able to provide the products, services, or communications that depend on that information. Please submit access and correction requests in writing to our Privacy Officer; we may ask you to verify your identity and to identify the information you are seeking. We will respond to a written request within 30 days, or notify you in writing within that period of any extension and its reason. Access is provided at little or no cost, and we will tell you of any fee in advance. We may refuse access where permitted or required by law (for example, information subject to privilege, information about another individual, or information relating to the detection of fraud), in which case we will give reasons and inform you of your right to complain to the Office of the Privacy Commissioner of Canada. Depending on applicable laws, these rights may also include the right to:

• Access your personal information.
• Know more about how we process your personal information.
• Rectify inaccurate personal information and, taking into account the purpose of processing, ensure it is complete.
• Request deletion of your personal information, where required or permitted by applicable law.
• Withdraw your consent to our use or disclosure of your personal information, subject to legal and contractual restrictions and reasonable notice.
• Receive your personal information , or have it transferred to another organization, in a structured and commonly used technological format, where required by applicable law.
• Object to certain processing of your personal information.
• Opt out of certain disclosures of your personal information to third parties.
• If you are under the age of 16, or another applicable age of consent, opt in to certain disclosures of your personal information to third parties.
• Not be discriminated against for exercising your rights.
• Not be subject to a decision based solely on automated processing, including profiling, which produces legal effects.
• Withdraw your consent at any time, to the extent we base processing on consent, without affecting the lawfulness of processing based on such consent before withdrawal.

Nevada Residents

Nevada residents may submit a verified request to us at [email protected] to request that we not make any sale, as defined under Nevada law, of any covered information, as defined under Nevada law, that we have collected or will collect about you. Please provide your name and contact information in your request, and we will respond in accordance with Nevada law.

Quebec Residents

If you are located in Quebec, the following additional provisions apply to you under the Act respecting the protection of personal information in the private sector, as amended by Law 25.

Consent. We obtain your consent to the collection, use, and disclosure of your personal information before or at the time of collection. Your consent must be clear, free, and informed, and is requested for specific purposes, in clear and simple language, separately from any other information we provide to you. Where we collect sensitive personal information, we obtain your express consent. Your consent is valid only for the time necessary to achieve the purposes for which it was requested, and you may withdraw it at any time using the contact details at the end of this Policy. We do not collect personal information from a person under 14 years of age without the consent of the person having parental authority, except where the collection is clearly for that person’s benefit.

Technologies that identify, locate, or profile you. Our Site uses technologies that may identify, locate, or profile you, including analytics cookies, session-recording and heatmap technology, and marketing automation site-tracking cookies, each of which is described in the “Cookies and Similar Technologies” section of this Policy. These technologies are not activated unless you have given your prior consent, and you may deactivate them at any time, and refuse or withdraw consent to them, through the cookie preferences link available on the Site. Profiling means the collection and use of personal information to assess certain characteristics of a natural person, including for the purpose of analyzing that person’s work performance, economic situation, health, personal preferences, interests, or behaviour.

Automated decision-making. We do not use your personal information to render a decision about you based exclusively on automated processing. If we do so in the future, we will inform you at the time of or before the decision, and on request we will tell you the personal information used to render the decision, the reasons and the principal factors and parameters that led to it, and your right to have that information corrected. You will also have the opportunity to submit observations to a member of our personnel who is able to review the decision.

Portability. On written request, you may obtain the computerized personal information you have provided to us in a structured, commonly used technological format, or have that information communicated to any person or body authorized by law to collect it, unless doing so raises serious practical difficulties. This right does not extend to information created or inferred by us.

De-indexing and cessation of dissemination. You may request that we cease disseminating your personal information, or that any hyperlink attached to your name that provides access to that information by a technological means be de-indexed, where the dissemination contravenes the law or a court order, or where the conditions set out in applicable Quebec law are met. You may also request the deletion of your personal information in the circumstances provided by law.

Communications outside Quebec. Before communicating your personal information outside Quebec, including to service providers in the United States or elsewhere in Canada, we conduct a privacy impact assessment that considers the sensitivity of the information, the purposes for which it is to be used, the protection measures that would apply to it, and the legal framework applicable in the jurisdiction in which the information would be communicated. We communicate the information only where the assessment demonstrates that it would receive adequate protection, and the communication is the subject of a written agreement that takes the results of the assessment into account.

Person in charge of the protection of personal information. Our Privacy Officer is the person in charge of the protection of personal information and is responsible for our compliance with applicable Quebec privacy legislation. You may contact the Privacy Officer using the details in the “Contact Us” section of this Policy to exercise any of the rights described above, and we will respond within 30 days of the request. If you are not satisfied with our response, you may file a complaint with the Commission d’acces a l’information du Quebec.

California Residents

All terms used in this section shall have the meanings given in the California Consumer Privacy Act, as amended (“CCPA”), when applicable.

CCPA Notice at Collection. We collect and process personal information as described in the “How do we collect and use personal information?” section of this Policy. The relevant CCPA categories for this information are listed below. We may provide a separate notice at collection if we collect additional information or intend to use information for additional purposes.

Tracking Technologies and Consent. We use cookies, analytics tools, and session-recording technologies on the Site only after you have given your prior consent through our cookie consent banner, and you may withdraw that consent at any time through the cookie preferences link. We recognize the Global Privacy Control and other opt-out preference signals as described in the “Choices About Cookies” section of this Policy. Third-Party Sites and Services

This Policy does not apply to any third-party website or applications. The Site may contain links to, and media or other content from, third parties. These links are to external resources and third parties that have their own privacy policies. Because of the dynamic media capabilities of the Site, it may not be clear which links are to external, third-party resources. If you click on a third-party link, you will be redirected away from the Site. You can check the URL to confirm whether you have left the Site.

We cannot and do not (1) guarantee the adequacy of the privacy or security practices employed by or the content and media provided by any third parties or their websites, (2) control third parties’ independent collection or use or your information, or (3) endorse any third-party information, products, services or websites that may be reached through embedded links on the Site.

Any information provided by you or automatically collected from you by a third party will be governed by that party’s privacy policy and terms of use.

Children

Our Site, products, and services are not directed to children under the age of 13, nor is information knowingly collected from children under the age of 13. No one under the age of 13 may access, browse, or use the Site or provide any information to us. If we learn that we have collected or received personal information from a child under the age of 13 without a parent’s or legal guardian’s consent, we will take steps to stop collecting that information and delete it. If you believe we have any received information from a child under the age of 13, please contact us using the “Contact Us” details provided below.

Updates and Changes to This Policy

We may add to, change, update, or modify this Policy from time to time. We will post all changes to this Policy on this page, and the updated policy will be effective immediately upon posting. If we make material changes, we will also notify you through the notice on the homepage of the Site for a reasonable period of time. We may also, in our discretion, notify you of changes to this Policy via email.

You are expected to, and you acknowledge and agree that it is your responsibility to, carefully review this Policy prior to using the Site, and from time to time, so that you are aware of its current terms. Your continued use of the Site after the “Last Updated” date will constitute your acceptance of and agreement to any changes and to our collection and sharing of your information according to the then-current Policy. If you do not agree with this Policy and our practices, you should not use the Site.
